Welcome to FindThatHere.com (“Site”), owned and operated by WENECO, LLC d/b/a FindThatHere.com (“Company,” “we,” “us,” or “our”).

These Terms of Use (“Agreement”) govern your access to and use of the Site, all services provided through the Site (“Services”), and any content, advertisements, communications, data, images, text, software, information, or other materials submitted to or made available through the Site (“Content”).

C. Marketplace Venue Only

The Company is not a buyer, seller, broker, dealer, auctioneer, escrow service, employment agency, recruiter, lender, insurer, real estate broker, transportation provider, or agent of any user.

The Company does not:

  • Verify ownership of advertised goods;
  • Verify the identity of users;
  • Verify the accuracy of advertisements;
  • Verify employment opportunities;
  • Verify property ownership or availability;
  • Verify vehicle history or title status;
  • Verify licenses, certifications, credentials, or qualifications;
  • Inspect goods or services offered through the Site.

Any transaction entered into between users is solely between those users.

The Company is not a party to any transaction and assumes no responsibility for disputes arising between users.

II. REGISTRATION AND ACCOUNTS

A. Eligibility

You must be at least eighteen (18) years of age, or the age of majority in your jurisdiction, whichever is greater, to create an account or use the Site in a manner requiring registration.

Under no circumstances may individuals under thirteen (13) years of age use the Site.

By registering for an account, you represent and warrant that you satisfy all eligibility requirements.

B. Registration Information

C. Account Security

You are solely responsible for maintaining the confidentiality of your username, password, authentication credentials, and account access information.

  3. Notify the Company immediately of any unauthorized use or suspected breach of security.

You remain responsible for all activity conducted through your account unless prohibited by applicable law.

The Company shall not be liable for losses resulting from unauthorized use of your account.

III. CONTENT

A. Definition of Content

For purposes of this Agreement, “Content” includes, without limitation:

  • Advertisements;
  • Text;
  • Graphics;
  • Photographs;
  • Audio;
  • Video;
  • Software;
  • Data;
  • Messages;
  • Reviews;
  • User profiles;
  • Communications;
  • Listings;
  • Any other material submitted, uploaded, transmitted, posted, displayed, or otherwise made available through the Site or Services.

B. Responsibility for Content

You are solely responsible for all Content that you submit, upload, post, display, transmit, distribute, or otherwise make available through the Site.

You represent and warrant that:

  1. You own or possess all rights necessary to publish the Content;
  2. The Content does not violate any law;
  3. The Content does not infringe the rights of any third party;
  4. The Content complies with this Agreement and all applicable policies.

You acknowledge that Content may be viewed by other users and may be copied, shared, archived, or redistributed by third parties.

C. License Granted to Company

You retain ownership of any Content that you submit to the Site.

By posting or submitting Content, you grant the Company a worldwide, perpetual, irrevocable, non-exclusive, transferable, sublicensable, royalty-free license to:

  • Use;
  • Copy;
  • Reproduce;
  • Store;
  • Archive;
  • Modify;
  • Adapt;
  • Translate;
  • Publish;
  • Display;
  • Distribute;
  • Promote; and
  • Create derivative works from

such Content in connection with operating, marketing, promoting, improving, and providing the Site and Services.

You acknowledge that no compensation shall be owed for any use of Content authorized under this license.

D. Content Disclaimer

The Company does not endorse, verify, guarantee, or assume responsibility for Content submitted by users.

The Company makes no representations regarding:

  • Accuracy;
  • Reliability;
  • Completeness;
  • Quality;
  • Legality;
  • Safety; or
  • Truthfulness

of any Content appearing on the Site.

Your reliance on any Content is solely at your own risk.

You acknowledge that Content may contain inaccuracies, omissions, offensive material, deceptive information, or other objectionable material.

The Company shall not be liable for any loss or damage arising from your reliance on Content.

E. Monitoring and Removal Rights

The Company reserves the right, but not the obligation, to:

  • Monitor Content;
  • Review Content;
  • Investigate Content;
  • Edit Content;
  • Refuse Content;
  • Remove Content;
  • Disable access to Content;
  • Preserve Content;
  • Suspend related accounts.

Such actions may occur at any time, with or without notice, and for any reason or no reason.

F. Content Retention

Deleted Content may remain in:

  • Archives;
  • Disaster recovery systems;
  • Search engine caches;
  • Third-party repositories.

The Company has no obligation to immediately delete Content from all systems.

G. User Disclosure of Information

You are solely responsible for information you choose to disclose through advertisements, messages, profiles, listings, communications, or other Content.

The Company is not responsible for the misuse of information disclosed by users.

Users should exercise caution when sharing:

  • Telephone numbers;
  • Financial information;

H. Third-Party Websites

IV. ADVERTISING TERMS AND CONDITIONS

B. Compliance With Laws

  • Product safety regulations;
  • Industry-specific regulations.

The Company does not provide legal advice regarding advertising compliance.

C. Right to Reject or Remove Advertisements

The Company reserves the right to reject, refuse, edit, remove, suspend, disable, or modify any advertisement at any time, with or without notice, and for any reason or no reason.

Acceptance of an advertisement does not constitute approval of its legality or compliance with applicable laws.

D. Advertising Fees

Advertisements offered through paid plans shall not be published until payment is received.

By purchasing advertising services, you agree to pay all applicable fees associated with the selected advertising package.

Advertising fees are charged for advertising placement services only.

E. No Refund Policy

Except where prohibited by law, all advertising sales are final.

Advertising fees are non-refundable.

F. Advertising Errors

Advertisers are responsible for reviewing all advertisements before publication.

The Company shall not be responsible for errors contained in advertisements submitted by advertisers.

Where a material error is caused solely by the Company, the Company’s sole obligation shall be issuance of advertising credit, not a cash refund.

G. No Guarantee of Results

The Company does not guarantee:

  • Views;
  • Traffic;
  • Leads;
  • Inquiries;
  • Applications;
  • Sales;
  • Rentals;
  • Responses;
  • Revenue; or
  • Any other outcome

arising from the placement of an advertisement.

H. User Verification Disclaimer

The Company does not verify:

  • Identity;
  • Ownership claims;
  • Professional licenses;
  • Certifications;
  • Qualifications;
  • Financial condition;
  • Background information;
  • Business legitimacy

of advertisers or users.

I. Fraud Warning

Users are solely responsible for conducting their own due diligence.

The Company strongly encourages users to independently verify all information and exercise caution when engaging in transactions involving:

  • Advance payments;
  • Wire transfers;
  • Cryptocurrency;
  • Gift cards;
  • Shipping arrangements;
  • Escrow requests;
  • Personal information.

The Company shall not be liable for fraud, scams, misrepresentations, theft, or other misconduct committed by users.

V. USER CONDUCT

A. Prohibited Conduct

The Company expects all users to act lawfully, responsibly, and respectfully while using the Site and Services.

  • Data-mining tools;
  • Artificial intelligence systems;
  • Machine learning systems;
  • Automated scripts;
  • Browser automation tools;
  • Bots; or
  • Similar technologies

to access, collect, monitor, copy, index, harvest, extract, reproduce, or otherwise use Content or data from the Site.

Any unauthorized automated access may result in immediate termination and legal action.

VI. TERMINATION

A. Company’s Right to Terminate

The Company may, in its sole discretion and without liability, suspend, restrict, disable, terminate, or refuse access to:

  • Any account;
  • Any advertisement;
  • Any Content;
  • Any feature;
  • Any Service;

at any time, with or without notice, and with or without cause.

B. User Termination

Users may terminate their accounts through the procedures made available on the Site.

Termination does not relieve users of obligations incurred prior to termination.

C. Effect of Termination

Upon termination:

  1. Your right to access and use the Site shall immediately cease.
  2. The Company may delete, archive, retain, or preserve account information and Content.
  3. Provisions intended to survive termination shall remain enforceable.

VII. PRIVACY

A. Privacy Policy

Use of the Site is also governed by the Company’s Privacy Policy, which is incorporated into this Agreement by reference.

B. Electronic Communications Consent

FindThatHere.com™, WENECO, LLC™, and related names, logos, service marks, and branding are the exclusive property of the Company.

You may not use Company trademarks without prior written permission.

C. Copyright Infringement Policy

The Company may remove Content alleged to infringe intellectual property rights and may terminate repeat infringers.

D. DMCA Notices

If you believe Content on the Site infringes your copyright, you may submit a written notice containing all information required by the Digital Millennium Copyright Act (“DMCA”), including:

  1. Identification of the copyrighted work;
  2. Identification of the allegedly infringing material;
  3. Contact information of the complaining party;
  4. A good-faith statement;
  5. A statement under penalty of perjury;
  6. A physical or electronic signature.

E. Counter-Notification Procedure

If you believe material was removed as a result of mistake or misidentification, you may submit a counter-notification containing all information required by applicable law.

IX. DISCLAIMER OF WARRANTIES

A. Services Provided “AS IS”

THE SITE, SERVICES, CONTENT, ADVERTISEMENTS, AND ALL RELATED FEATURES ARE PROVIDED ON AN “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

  • MERCHANTABILITY;
  • FITNESS FOR A PARTICULAR PURPOSE;

  • NON-INFRINGEMENT;
  • ACCURACY;
  • AVAILABILITY;

B. No Guarantees

The Company does not warrant that:

  • The Site will be uninterrupted;
  • The Site will be error-free;

  • Users will be trustworthy;

  • Defects will be corrected.

C. Third-Party Goods and Services

X. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless the Company and its officers, directors, members, employees, affiliates, contractors, agents, successors, and assigns from and against all claims, liabilities, damages, judgments, losses, costs, expenses, and attorneys’ fees arising from or related to:

These obligations survive termination of this Agreement.

XI. LIMITATION OF LIABILITY

A. Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR:

  • INDIRECT DAMAGES;
  • INCIDENTAL DAMAGES;
  • SPECIAL DAMAGES;
  • CONSEQUENTIAL DAMAGES;
  • EXEMPLARY DAMAGES;
  • PUNITIVE DAMAGES;
  • LOSS OF PROFITS;
  • LOSS OF DATA;
  • LOSS OF BUSINESS;
  • LOSS OF GOODWILL.

B. Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY’S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF:

  • ONE HUNDRED DOLLARS ($100.00); OR
  • THE TOTAL AMOUNT PAID BY YOU TO THE COMPANY DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

C. User Disputes

The Company is not responsible for disputes between users.

To the fullest extent permitted by law, you release the Company from any claims, demands, damages, liabilities, and expenses arising from disputes with other users.

XII. EXCLUSIONS

Some jurisdictions do not permit certain warranty disclaimers or liability limitations.

Accordingly, portions of this Agreement may not apply to certain users to the extent prohibited by applicable law.

XIII. INTERNATIONAL USERS

Users accessing the Site outside the United States do so at their own initiative and are responsible for compliance with local laws.

The English-language version of this Agreement shall govern and control in the event of any conflict with a translated version.

XIV. GENERAL CONDITIONS

A. Entire Agreement

This Agreement and all policies incorporated by reference constitute the entire agreement between the parties.

B. No Waiver

Failure by the Company to enforce any provision shall not constitute a waiver of that provision.

C. Survival

Provisions concerning intellectual property, disclaimers, indemnification, limitations of liability, dispute resolution, and similar provisions shall survive termination.

D. Governing Law

This Agreement shall be governed by the laws of the State of Tennessee without regard to conflict-of-law principles.

E. Venue and Jurisdiction

Any dispute arising from this Agreement shall be brought exclusively in the state or federal courts located in Roane County, Tennessee, and you consent to the personal jurisdiction of such courts.

The Company may seek injunctive relief in any jurisdiction necessary to protect its rights.

F. Severability

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

G. Limitation Period

Any claim arising from or relating to the Site, Services, or this Agreement must be filed within one (1) year after the claim arises or be permanently barred.

H. Assignment

The Company may assign, transfer, or delegate this Agreement without restriction.

You may not assign or transfer this Agreement without prior written consent from the Company.

I. Force Majeure

The Company shall not be liable for delays, interruptions, failures, or unavailability caused by events beyond its reasonable control, including:

  • Natural disasters;
  • Fires;
  • Floods;
  • Epidemics;
  • Pandemics;
  • Utility failures;
  • Internet outages;
  • Cyberattacks;
  • Labor disputes;
  • Government actions;
  • War;
  • Terrorism;
  • Failures of third-party providers.

J. No Agency Relationship

Nothing in this Agreement creates any partnership, joint venture, employment, agency, fiduciary, or franchise relationship between the Company and any user.

K. Compliance with Laws

Users are solely responsible for complying with all applicable laws and regulations relating to their use of the Site and Services.

XV. VIOLATIONS

Users are encouraged to report suspected violations of this Agreement through the support mechanisms provided on the Site.

The Company reserves the right to investigate alleged violations and take any action it deems appropriate, including content removal, account suspension, account termination, referral to law enforcement, or legal action.

The Company’s decision regarding enforcement of this Agreement shall be final.

These Advertising Policies and Guidelines (“Guidelines”) govern all advertisements, listings, submissions, images, communications, and promotional content posted through FindThatHere.com (“Site”), owned and operated by WENECO, LLC d/b/a FindThatHere.com (“Company”).

These Guidelines are incorporated into and form part of the FindThatHere.com Terms of Use. By posting, publishing, purchasing, or responding to advertisements on the Site, you agree to comply with these Guidelines.

The Company reserves the right, in its sole discretion, to reject, edit, remove, suspend, refuse publication of, or otherwise restrict any advertisement, account, listing, image, or content that violates these Guidelines, the Terms of Use, applicable law, or that otherwise negatively impacts the Site, its users, or the Company.

I. GENERAL MARKETPLACE POLICIES

A. Classified Advertising Platform

FindThatHere.com operates solely as an online classified advertising platform.

The Company:

  • Does not act as a broker, dealer, auctioneer, escrow service, recruiter, lender, insurer, transportation provider, or agent of any user;
  • Does not participate in transactions between users;
  • Does not guarantee the accuracy of listings;
  • Does not guarantee the identity of users;
  • Does not verify ownership of advertised property;
  • Does not inspect goods or services offered for sale.

Users are solely responsible for evaluating listings and conducting their own due diligence.

B. No Guarantee of Results

The Company does not guarantee:

  • Advertisement views;
  • Traffic;
  • Leads;
  • Sales;
  • Rentals;
  • Employment applications;
  • Business opportunities;
  • Responses;
  • Revenue;
  • Any other outcome.

Advertising fees are charged solely for advertising placement services.

C. Right to Refuse Service

The Company reserves the right to:

  • Reject advertisements;
  • Refuse service;
  • Remove listings;
  • Suspend accounts;
  • Terminate accounts;
  • Restrict categories;
  • Remove images;
  • Modify listings;

at any time and for any lawful reason, with or without notice.

II. MARKETPLACE SAFETY NOTICE

The Company strongly encourages users to exercise caution when engaging in transactions.

The Company does not verify:

  • User identities;
  • Vehicle ownership;
  • Vehicle titles;
  • Vehicle history reports;
  • Property ownership;
  • Property availability;
  • Employment opportunities;
  • Professional licenses;
  • Certifications;
  • Insurance coverage;
  • Credentials;
  • Qualifications;
  • Business legitimacy;
  • Financial information.

Users should independently verify all information before entering into a transaction.

The Company recommends:

  • Meeting in safe public locations;
  • Inspecting items before payment;
  • Verifying ownership documentation;
  • Using caution when providing personal information;

III. ACCOUNT AND LISTING LIMITATIONS

A. Account-Based Limits

The number of advertisements, images, listing duration, promotional features, and advertising privileges available to a user may depend upon the account type or advertising package selected.

The Company may modify account features, package offerings, pricing, limits, and privileges at any time.

B. Duplicate Listings

Duplicate or substantially similar advertisements are prohibited.

Advertisements may be removed if they:

  • Offer the same item or service;
  • Appear multiple times in the same category;
  • Artificially increase exposure;
  • Circumvent account limitations.

Users must remove existing listings before reposting the same item unless otherwise permitted.

C. Category Accuracy

Advertisements must be placed in the most appropriate category.

The Company may move, recategorize, edit, or remove listings placed in incorrect categories at its sole discretion.

IV. PROHIBITED ACTIVITIES

The following activities are prohibited unless expressly authorized in writing by the Company:

  1. Advertising goods or services located outside the United States.
  2. Advertising goods or services that are illegal in any applicable jurisdiction.
  3. Posting advertisements intended primarily to redirect traffic to another website.
  4. Operating referral schemes, traffic generation schemes, or lead-generation schemes through advertisements.
  5. Posting misleading, deceptive, fraudulent, or false advertisements.
  6. Collecting personal information for unauthorized marketing purposes.
  7. Posting advertisements that violate intellectual property rights.
  8. Advertising counterfeit products.
  9. Encouraging illegal activity.
  10. Circumventing Site policies.
  11. Creating multiple accounts to avoid account limitations.
  12. Manipulating listing rankings or search results.
  13. Posting advertisements on behalf of another person without authorization.
  14. Using automated tools to create, publish, monitor, or manipulate advertisements.
  15. Using the Site for spam, phishing, malware distribution, or fraudulent activity.

V. PROHIBITED GOODS, SERVICES, AND CONTENT

The Company reserves the right to prohibit any product, service, activity, category, advertisement, image, or listing at any time in its sole discretion.

A. Adult Content

Including:

  • Prostitution;
  • Escort services involving sexual activity;
  • Pornography;
  • Obscene material;
  • Nudity;
  • Sexual services;
  • Human trafficking;
  • Adult personals;
  • Sexually explicit products or services.

B. Alcohol

Including:

  • Alcoholic beverages;
  • Distilled spirits;
  • Wine;
  • Beer;
